SUPREME COURT: SECTION 27 OF EVIDENCE ACT IS APPLICABLE ONLY IF CONFESSION LEADS TO ISCOVERY OF A NEW FACT

The Supreme Court in the case of Navaneethakrishnan v. The State by Inspector of Police has reiterated the settled legal proposition that Section 27 of the Evidence Act is applicable only if the confessional statement by the accused leads to the discovery of some new fact. It was also observed that though the last seen theory is an important detail in the chain of circumstances that would completely establish or could point to the guilt of the accused with some certainty, but this alone cannot be taken into consideration to discharge the burden of establishing the guilt of the accused beyond reasonable doubt.
